Drug Treatment Court 

Drug Treatment Court is designed to identify and involve participants with opioid and stimulant use disorders to stabilize their recovery and drastically reducing overdose fatalities and recidivism by providing them with a blend of treatment resources, supervision, and accountability. Drug Treatment Court has two possible tracks: 1) Post Guilty Plea/Pre-Sentencing and 2) Post Sentencing as a condition of the County Restrictive Probation (CRP).

For participants in the Post Guilty Plea/Pre-Sentencing track, sentencing will be deferred pending completion of Drug Treatment Court. Upon successful completion of the program, including payments of fines, costs, and restitution, the participant's charges may be reduced or dismissed, depending on the severity of the original charges and at the discretion of the Cumberland County District Attorney's Office. Participants acknowledge prior to entering a Drug Treatment Court guilty plea that they will not be allowed to withdraw the Drug Treatment Court guilty plea. Failure to complete the program successfully will result in the participant being sentenced. 

Participants who are charged with new offenses while enrolled in CRP may be admitted into Drug Treatment Court. If approved for Drug Treatment Court, the CRP judge will retain the participant in the CIP and make completion of Drug Treatment Court a condition of the CRP sentence. DUI participants who enter Drug Treatment Court as a condition of CRP will not have the underlying DUI expunged. 

Once accepted, program participants can expect frequent contact with the presiding Drug Treatment Court Judge Jessica Brewbaker, Probation Officer, Treatment Providers, and the Drug Treatment Court Team. The Drug Treatment Court Program involves a minimum time commitment of fourteen (14) months. The participant will be expected to participate in and complete numerous pro-social, treatment-orientated activities, such as AA/NA meetings or approved alternatives, including Al-Anon and Nar-Anon, group and individual therapy, weekly court appearances, community service, probation appointments, and random urine testing. As each participant requires a different level of intervention based on need and progress, a participant's specific needs may require the participant to be involved in other activities as a condition of Drug Treatment Court.
